What Does the Supreme Court Decision Mean?
The Decision handed down today by the Californian Supreme Court is not really a surprise given that Proposition 8 was passed by a majority of voters.
But it's a significant disappointment and I am sure that everyone would have liked the dissenting vote to be the majority vote.
Yes the Proposition does go against the equality as the lone dissenter suggested:
"The majority's holding is not just a defeat for same-sex couples, but for any minority group that seeks the protection of the equal protection clause of the California Constitution," wrote Moreno, the court's only Democratic appointee.
I always believed that Government and the courts were supposed to look after the minorities in society, but in this case the Republican appointed Californian Supreme Court has voted on the technicality of the vote, and not the legality of the meaning of the vote.
There is one small silver lining in the continued recognition of he 18000 Same Sex marriages already performed in California which is a small step at least.
Where to now, I don't know.
I think there will again be some large protests in California, especially against the Church of latter Day Saints.
But I am not sure that these protests will work.
Over the last ten years the number of people who support Same Sex Marriage has steadily grown and other states of the USA are enacting legislation to recognize our relationships.
Whilst this may be a large step back we have been making many small steps forward.
It will happen and Same Sex Marriage will eventually be legal in all States, we all have to continue moving forward and pushing the issue.
